Criminal procedure — Prosecution — Prosecuting authority — Decision to discontinue prosecution — Reviewable on principle of legality, not under Promotion of Administrative Justice Act 3 of 2000.

I have great news today – my good friend and colleaque, Advocate Matthew Klein, founder member of the National Bar Council of South Africa and member of our executive council responsible for training and ethics, has agreed spontaneously to the publishing of his monthly summaries of case law on my web site. I thank you Mattie from the bottom of my heart and know that every user will benefit from your altruistic work as the NBCSA have benefitted for years now.
In his Legal Notes Vol 9-2014 Advocate Klein included the case of NATIONAL DIRECTOR OF PUBLIC PROSECUTIONS AND OTHERS v FREEDOM UNDER LAW 2014 (2) SACR 107 (SCA) with its summary – Criminal procedure — Prosecution — Prosecuting authority — Decision to discontinue prosecution — Reviewable on principle of legality, not under Promotion of Administrative Justice Act 3 of 2000. I will file the complete summary under the CASE LAW page.
